Important information about Wills and trusts
It’s very important to plan for the future of your family and loved ones with a learning disability.
You need to protect their means tested benefits and support packages.
If you take the right action their benefits and support do not need to change.
Here is some useful information:
What is a Will?
A Will says what happens to everything you own when you die.
What is a trust?
A trust looks after money, property and other important things. It works like a piggy bank. It can be used straight away.
Why set up a trust
This is one of the most important things you can do for the future.
It will help:
· Keep money safe
· Keep people’s lives the same as possible
Make sure people can keep doing the things they love
Can I just give all my money to someone?
No. Leaving your money to someone without a plan can change their benefits.

What happens if I don’t make a Will?
If you don't make a Will the government will decide what happens to your money and property.
They follow set rules about who gets what. The rules don't think about what you want or what your family needs.
What is a trust?
A trust protects your money and property more than a Will. This is because people called trustees look after the money in the trust.
Setting up a trust is difficult. You need a lawyer who knows about trusts for people with disabilities.
How do I make a trust?
A lawyer will talk to you about what you want. They will tell you which type of trust is best.
The trustees will give the trust money to the people you want to help.
A person who gets the money is called a beneficiary.
